The price of calls and the billing unit for calls is charged at the price of calls to the fixed networks of the telecommunications operator of the user of the info phone.

The working hours of the info phone are on weekdays from 8:00 a.m. to 8:00 p.m., and on Saturdays from 8:00 a.m. to 4:00 p.m. 
Customer support is not available on Sundays and holidays.

The customer

A product buyer is any natural person that buys products via the Internet store in the manner regulated by these General Terms and Conditions.

Prior to the purchase, the customer declares that he has read these General Business Terms and consequently accepted them, as well as that he is aware that the product order includes the payment of the purchase price and the cost of delivery, where applicable, and that he has been informed of the terms, deadlines and execution procedure the right to unilaterally terminate the sales contract, and that he has understood and accepted all conditions and notices.

A natural customer can only be an adult and capable of doing business. Contracts can be concluded in the name and on behalf of minors and persons completely incapable of business by their legal representatives or guardians. Persons with partial business capacity can conclude a contract only with the consent of their legal representative or guardian. The Seller bears no responsibility for actions contrary to this provision.

Customers are obliged to provide accurate, valid and complete personal data when filling out the registration form. The contrary behavior of the Buyer authorizes the Seller to refuse the sale of the product or the provision of its services.

General Provisions

The seller provides an online service through his website on the www.studiomartinac.com domain. The service consists of providing information services, managing content, and conducting financial transactions.

The customer is personally responsible for protecting the confidentiality of passwords. The Buyer is aware of the fact that there are sometimes service interruptions or events that are beyond the Seller’s control and accepts that the Seller is not responsible for any loss of data or any damage to the Buyer’s electronic devices that may occur, due to reasons beyond the Seller’s control can affect, during the transfer of information on the Internet. The customer agrees and accepts that access to the Website may sometimes be interrupted, temporarily unavailable, or completely disabled.

The seller reserves the right at any time to modify or terminate any segment of the business, including, without limitation, the content, time of availability, as well as the equipment required to access or use the pages. Furthermore, Studio Markovic may stop sending any part of the information or any type of information, change or discontinue any method of data transmission, change data transmission speeds, and any other characteristics thereof.

Studio Markovic reserves the right at any time, and without prior notice, if it deems it necessary, to cancel or amend any of the General Terms and Conditions of Business and Use and/or the Data Confidentiality Statement stated here. It is understood that the Customer accepts the changes by continuing to use the website even after the publication on the internet of the new amended General Terms and Conditions of Business and Use, i.e. the Confidentiality Statement.

All products of Studio Markovic are described on the website www.studiomartinac.com in the most authentic way possible, and this includes form, color, size, dimensions, and the like. However, each product may vary by 2% in width and length from the written dimensions.

This website is privately owned. All mutual communication and interaction that takes place through these Internet pages must be in accordance with these General Terms and Conditions of Business and Use.

All materials found on www.studiomartinac.com website are the exclusive right of the Seller or are used with the express permission of the copyright holder and trademark and/or design rights holder.

The customer expressly agrees that the use of the website www.studiomartinac.com is solely at the customer’s own risk so Studio Markovic does not guarantee for: 1. The consequences that may arise from the use of this website, or 2. The accuracy, reliability, or content of any information, services, or goods provided through this website.

The customer expressly confirms that Studio Markovic is not responsible for the offensive, inappropriate or illegal behavior of the customer or third parties and that the risk of damages that may arise as a result of the aforementioned rests entirely with the customer.

In addition to the aforementioned conditions, Studio Markovic will not be responsible, regardless of the cause or duration, for any errors, inaccuracies, or other defects, inappropriateness, or unoriginality, of the information found on this website, as well as for any delay or interruption in the transmission of information to the customer or for any claims or losses arising therefrom.

The Seller reserves the right to immediately cancel any passwords or user accounts of the Buyer in case of any behavior that the Seller, in its discretion, considers unacceptable, as well as in any case of non-compliance with the General Terms and Conditions of Business and Use by the Buyer.

The buyer can send his inquiries and comments in writing, by post or e-mail, and the Seller will send a written answer by post or e-mail within the legal deadline.

The Headquarters of Studio Markovic is in Zagreb, in the Republic of Croatia. Legal disputes that may arise as a result of the use of these Internet pages (unless otherwise stated in a separate contract) are under the jurisdiction of the court in Zagreb and are resolved in accordance with the positive regulations of the Republic of Croatia. By using these Internet pages, the Customer agrees that any dispute or claim arising from, or related to, these Terms, or in connection with their implementation, is under the jurisdiction of the court in Zagreb.

Terms of use of the services of the website www.studiomartinac.com

The condition for using the www.studiomartinac.com website is the successful registration of the Customer. As part of the registration, the Customer will be offered acceptance of these General Terms of Use, the acceptance of which is a prerequisite for using the services of the www.studiomartinac.com website.
Studio Markovic invites the Customer to view the content of the Confidentiality Statement. Studio Markovic recommends that the Customer take care of their login password for the www.studiomartinac.com user account.

Language

The language of communication on the website www.studiomartinac.com is the English literary language.

Prices

All prices represent retail prices and are expressed in Euros (EUR) and include VAT. Studio Markovic reserves the right to change retail prices unless otherwise stated (in the case of promotions and other special types of sales). The specified retail prices are valid only for the purchase of products via the Internet store and may differ from the retail prices in the Seller’s stores.

Special sale

Duration periods and conditions of promotions and other special forms of sales (promotional sales, sales, seasonal discounts, etc.) are listed with each such offer.
After the end of the promotional sale period, www.studiomartinac.com will not accept new orders under the terms of the expired special sale.

Product availability and delivery time

Croatian Post (HP e-packet) delivers products or services to Croatia within a maximum of 48 hours from picking up the shipment at the Studio Markovic warehouse (excluding weekends and holidays). The exception is the islands, where delivery is made within a maximum of 72 hours from the collection of the shipment at the studiomartinac.com warehouse. Within European Union (including The United Kingdom, Switzerland, and Norway) the delivery takes 3-5 days, and to all other countries beyond Europe 7-10 days. In-stock items can be shipped straight away, for other handmade pieces creation time estimates are stated on the product page.

Also, the delivery term can be extended in the event or events that the Seller could not foresee or prevent. In both cases, the Buyer will be informed in a timely manner of the expected delivery date in the manner prescribed by these conditions.

The product is delivered to the Customer exclusively on working days during the working hours of the delivery services. The customer will be contacted in advance to agree on the delivery date.
The purchased Products will be delivered in accordance with the above-mentioned conditions if the address indicated for delivery can be accessed from a public traffic area by means of transport.

Duration and termination of the contract (unilateral termination of the contract by the customer)

The contract that the Customer concludes with Studio Markovic for the purchase and sale of products and services is a one-time contract for the purchase and sale of products or services that is consummated by the delivery of goods or services by Studio Markovic and the payment made by the Customer, in the event that it is not terminated. These General Terms and Conditions are an integral part of the Purchase Agreement between Studio Markovic and the customer.

Pursuant to the Law on Consumer Protection, the Buyer is authorized to unilaterally terminate the contract without giving reasons within 14 days from the date of delivery of the product, i.e. delivery of the last product from the order.

An exception to this authorization applies to products for which Art. 79 of the Consumer Protection Act excludes the right to unilateral termination of the contract, which the Seller will specifically warn you about in the offer of the specific product.

Unilateral termination of the contract can be done by the Buyer through any unequivocal written statement expressing his will to terminate the concluded sales contract, sent to the Seller at the address Studio Markovic, Kotorvaroška 7, 10 020 Zagreb or by e-mail: markovic.studio@gmail.com, in to which he will state his name and surname, address, telephone number, e-mail, information about the received product and a copy of the invoice.

The seller is obliged to deliver to the buyer a confirmation of receipt of the declaration of termination of the contract without delay. In the event that the Buyer terminates the contract, the Seller shall return to the Buyer the entire amount paid, minus the cost of delivery, if any, within 14 (fourteen) days at the latest from the day he received the returned product, in accordance with the terms of these General Terms and Conditions in the same way as the payment was made, unless the Buyer expressly agrees to another means of payment and assuming that the Seller is not obliged to pay any additional costs for such a return. The refund of the paid amount will be made to the Buyer only after the Seller has received the product at the address indicated on the invoice.

The cost of returning the goods based on the unilateral termination of the contract by the Buyer shall be borne by the Buyer.

In case of termination of the contract by the Buyer as stated above, for a refund of the entire amount of money received, the returned products must be  unused, undamaged and in undamaged original packaging with a copy of the invoice attached.

The exchange of the correct product (e.g. incorrect number of clothes, incorrect color of the product) is done in writing via e-mail to markovic.studio@gmail.com. Products (return or replacement) must be delivered or sent by post to the address: Studio Markovic, Kotorvaroška 7, 10 020 Zagreb.

Pursuant to Article 77, Paragraph 5 of the Law on Consumer Protection, the customer is responsible for any decrease in the value of the purchased product resulting from the handling of the purchased product, which has been established as an obligation of the consumer in case of unilateral termination of the contract within the legal term of 14 days.

Consequently, Studio Markovic recommends to its customers when taking over the product, and in connection with the unilateral termination of the contract within the legal term of 14 days:

– that the image of the product shows the basic appearance and the way of using the product as well as the presentation of the product as foreseen by the manufacturer. The picture does not show in detail the specific product delivered to the customer, therefore studiomartinac.com recommends the customer to review in detail the characteristics of the products listed on the studiomartinac.com website when choosing a product.

– if the packaging is damaged, do not pick up the product, but draw the attention of the delivery person to the damage to the packaging and request that the product be returned to Studio Markovic. If the customer does not report the damage to the packaging to the delivery person at the time of taking over the product, it is considered that he took over the product with undamaged packaging.

– carefully examine the product, its nature, characteristics and functionality, but do not use the product or handle it if you intend to use the legal right of termination of the contract, because any further handling of the product reduces the value of the product.

The handling/use of the product is considered, for example, for clothes – wearing for a certain time, going out in clothes, etc., for bags and backpacks – carrying things, for fashion accessories – wearing on the body, tools – using for their purpose, lighting – mounting. Handling the product reduces the value of the product.

In the event that the customer orders goods and refuses to receive them without reason (the packaging is not damaged), Studio Markovic has the right to deduct from the paid amount of the purchase price the amount of the direct costs of returning the product.

Studio Markovic is responsible for the material defects of the items it sells on its website in accordance with positive regulations, in particular the Law on Obligations of the Republic of Croatia.

Studio Markovic, in cooperation with the service department, determines to which category the returned product belongs after receiving the product. The buyer will receive notification about the status of the returned product and the amount of the refund within 10 days via email. Refunds to the customer will be made no later than 5 days from the date of notification to the customer.

The right to unilateral termination of the contract is excluded by law in several cases and these cases are included in the above tables. Complete information related to the right of the customer to unilaterally terminate the contract can be found at this link:

Written complaint, response, notifications

If you are dissatisfied for any reason, you can file a complaint with Studio Markovic.
Studio Markovic allows you to submit a written complaint by mail, telephone + 385 98 1787398 or by e-mail markovic.studio@gmail.com. In order to determine the specific order against which you have a complaint as quickly as possible, please state the order number, account number or your username in the complaint. Studio Markovic will confirm the receipt of the complaint in writing without delay, and according to the law, the answer must reach you within 15 (fifteen) days from the date of receipt of the complaint.
In the event of a dispute before the court, the competent court is the court in whose territory the Seller’s seat is located.
European Commission Regulation no. 524/2013 on the online resolution of consumer disputes, which has been in force since January 9, 2016, the Platform for Online Resolution of Consumer Disputes (Platform for ORS) was put into operation.

• Internet banking, mobile banking… If you choose this payment method, you will receive an offer to your email address with all the information required for payment, including the account number to which you need to pay the value of the order. You can then make the payment using internet banking or the way you normally pay your bills – through the bank, post office, etc. We receive payments to the account of Raiffaisen bank. IBAN: HR9224840081135154288

When collecting in person, please first check whether the goods are ready for collection by phone number + 385 98 1787398, and when collecting, bring a copy of the invoice previously sent to your e-mail address. Picking up the goods in person with us is free of charge and no additional costs are charged.

NOTE: for Burmese payments, the goods are delivered only after we post the payment (according to bank statements – as a rule, the next working day), so we also ask you to check the status of the shipment beforehand on the phone number + 385 98 1787398.

The deadline for payment of the purchase price of the product (the amount stated on the confirmed order) is 3 (three) days from the day the Buyer receives the Seller’s notification of the confirmed order, except in the case of cash on delivery. In the event that the Buyer does not pay the purchase price within that period, and the Seller and the Buyer have not agreed otherwise, the order confirmation becomes non-binding for the Seller and it is deleted from the system.

If the Payer is not the person receiving the product, the seller reserves the right to additional verification of identity and consent to pay for the ordered goods and these conditions.
